Dupixent Lawsuit Status: MDL 3180 (Updated 2026)

On June 4, 2026, the U.S. Judicial Panel on Multidistrict Litigation centralized federal Dupixent cancer lawsuits into MDL No. 3180, In re: Dupixent (Dupilumab) Products Liability Litigation, in the District of New Jersey before U.S. District Judge Zahid N. Quraishi. The order followed a consolidation motion filed February 13, 2026 and argument heard in late May 2026.

The litigation began with 15 cases pending across 12 federal districts, filed by 8 law firms. Plaintiffs first asked for the Northern District of Georgia. Sanofi and Regeneron agreed that consolidation made sense but asked for a different venue. The panel chose New Jersey, noting Sanofi has its principal place of business there and Regeneron has offices in New Jersey with headquarters nearby in Tarrytown, New York. The transfer covered the 15 cases plus 7 potential tag along actions.

Plaintiffs allege that Dupixent caused them to develop CTCL or accelerated a preexisting CTCL, and that Regeneron and Sanofi failed to warn patients and doctors. The legal theories include failure to warn, design defect, and negligence.

An MDL is not a class action. Each plaintiff keeps a separate, individual claim. Cases are coordinated for efficiency during pretrial proceedings.

The court will oversee coordinated discovery and is expected to set up bellwether trials, a small set of representative cases tried to help both sides gauge how juries view the evidence. The MDL currently focuses on CTCL claims, and other T cell lymphomas may be added later through the conditional transfer process. As of this update, there are no settlements and no trial verdicts.
